WHAT THIS WARRANTY COVERS

When used and maintained in normal household use and in accordance with the Owner’s Manual, your O2Remote device is warranted against original defects in material and workmanship for a full 3 year period from date of customer purchase. During the Warranty Period, OMS, LLC or an authorized agent will provide labor and parts, at no cost to you, to correct any such defect in product purchased in the United States. User will be responsible for all shipping costs.

HOW TO MAKE A WARRANTY CLAIM

If this product is not as warranted, call 918-943-3513 and notify Customer Service for repair and replacement options.

WHAT THIS WARRANTY DOES NOT COVER

This Warranty does not cover improper maintenance of the product, damage due to misuse, acts of God, nature, vandalism or other acts beyond the control of OMS, LLC, owner’s acts or omissions, use outside the country in which the product was initially purchased. This warranty does not cover pick up, delivery, transportation or house calls. The Warranty period will not be extended by any replacement or repair performed under this warranty.

OTHER IMPORTANT TERMS

IN NO EVENT WILL OMS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE TO OWNER OR ANY PARTY CLAIMING THROUGH OWNER, WHETHER BASED IN CONTRACT, NEGLIGENCE, TORT OR STRICT PRODUCTS LIABILITY OR ARISING FROM ANY CAUSE WHATSOEVER.

By purchasing a product from Oxygen Management Systems, LLC, buyer agrees to:

1. Assume ANY and ALL RISKS of INJURY OR DEATH resulting from use of the product,

2. WAIVE, RELEASE, and NOT SUE, MAKE ANY CLAIMS OR FILE ANY ACTIONS against Oxygen Management Systems, LLC or any other owner or operator of businesses offering products through this website, or any one of the aforementioned entities and each of their insurance carriers, subsidiaries, affiliates, officers, directors, shareholders, members, representatives, assignee's, employees, volunteers and agents, as well as any manufacturers and distributors (hereinafter the “Indemnified Parties” collectively, the “Indemnified Party” individually) that are based on, arise or result from, in whole or in part, use of the product, and

3. INDEMNIFY, DEFEND AND HOLD THE INDEMNIFIED PARTIES HARMLESS, from any and all claims, demands, actions, causes of action, losses or liabilities whatsoever arising from or related to participation in any activity and any loss, damage or injury, including death, that may be sustained by buyer or assignee, or caused to others or their property by buyer or assignee.  Buyer also agrees to pay all costs, including reasonable attorneys’ fees and disbursements, incurred by any Indemnified Party in defending an investigation, claim or suit brought by or on behalf of Buyer or assignee.

In no event shall our company be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of our products.

OMS offers a 30 day money back guarantee. Your 30 days begin from the date of your purchase. If you are not satisfied with your product for any reason, you may return the item to us for a refund of your purchase price EXCLUDING shipping and a $5 re-stocking fee. You will be responsible for shipping charges to return the item to OMS. OMS will refund sales tax, if any tax was charged at the time of purchase after the item has been returned.The item must be returned in like new condition.  Any damages to the product will void this offer.  Before returning the item, you must call OMS at (918) 943-3513 to receive a Return Authorization. Failure to do this will void this offer.
